The Terms and Conditions stated herein are the terms and conditions between PraIn Fintech Co., Ltd. (hereinafter referred to as “Service Provider”) and Users of electronic payment services (hereinafter referred to as “Service User” or “Service Users”), where the Service Provider wishes to serve as an agent for receiving payments for goods and/or services provided by Merchant (hereinafter referred to as “Merchant” or “Merchants”) through an electronic payment system or Payment Gateway under the trade name “ChillPay”. The Service User is obliged to thoroughly read Terms and Conditions Regarding Electronic Payment Services (hereinafter referred to as the “Agreement”) prior to using such payment service. Should the Service User be in doubt of this Agreement, the Service User shall contact for inquiries at the telephone number 02-107-7788 or any other channels specified by the Service Provider.
To access and use the electronic payment services, by any and all means, the Service User accepts the terms and conditions of this Agreement. Should the Service User do not accept the terms and conditions of this Agreement, the Service User shall not access and use the electronic payment services provided by the Service Provider. The Service User shall not be entitled to use the electronic payment service.
The Service User has made an agreement to the Service Provider as follows:
1. General Terms and Conditions
1.1 The Service User agrees to abide by and be bound by terms of service. Use of service provided by Service Provider is considered an acceptance of the terms of service. The contents of this Agreement may be changed, amended, or added at any time. The Service Provider is not required to inform the Service User prior to such changes. Use of service after changes, amendments, or addition of terms of service shall be considered an acceptance of the terms of service with such changes.
1.2 Unless notified or otherwise specified, the nature or contents of this Agreement that have been changed, amended, added, or improved on the Service shall be deemed to be subject to these terms of service.
1.3 The Service Provider, at any time, reserves the right to improve or cancel any and all part of Services, either temporary or permanently, without prior notice to the Service User. The Service User, in all cases, may not request for a claim of any damages incurred from such action. In addition, should there be any civil or criminal liabilities, including any damages arising from breach of terms and conditions of this Agreement, the Service User shall be solely responsible for such liabilities and/or damages, without an involvement of the Service Provider in any way.
2. Use of Services
2.1 The Service Provider wishes to serve as an agent for receiving payments for goods and/or services provided by Merchants through the electronic payment system (Payment Gateway) under the trade name “ChillPay”, and the Service User wishes to receive the payment services for goods and/or services through such system (hereinafter referred to as “Service” or “Services”)
2.2 The Service User agrees to pay the service fee at the rate specified by the Service Provider (if any). The Service User may check the service fee at the Merchant’s payment page. The Service Provider reserves the right to change the rate of the service fee at any time without prior notice to the Service User.
2.3 The Service User acknowledges that the Service Provider is only the facilitator for payment services for goods and/or services, and any transactions according to the orders of the Merchants. Should there be any problems with goods and/or services, or defects of goods and/or services, or any disputes arising, the Service User must contact the Merchant directly by himself.
In addition, as the provider of payment services for goods and/or services, the Service Provider does not engage in any part of agreements, terms of service, or any rights and duties between the Service Users and Merchants. Should there be any disputes arising from the Service Provider’s payment services for goods and/or services, either the overdue payments, partial payments, suspension of service, or any other cases, the Service User shall be responsible for and/or resolve such disputes by himself, without an involvement of the Service Provider in any way.
2.4 The Service User accepts and confirms that the use of service under this Agreement does not have a nature of acting as an agent in issuing tax invoices, according to the Notification of Director-General of the Revenue Department on Value Added Tax (No. 68). The Service Provider is only a service provider in facilitating payment services for goods and/or services, and any transactions according to the orders of the Merchants only. Should the Service User wish to receive the tax invoices for goods and/or services that the Service User has made payment to the Merchant, the Service User must contact the Merchant directly by himself.
2.5 Should the Service User wish the Service Provider to issue tax invoices for service fee stated in Clause 2.2 (if any), the Service User may request such tax invoices by contacting telephone number 02-107-7788 or any other channels specified by the Service Provider within the same day that the payments for goods and/or services has been made.
The Service Provider reserves the right to issue tax invoices to the Service User who contacts the Service Provider after the date that the Service User has made a payment for goods and/or services.
2.6 The Service User acknowledges that the Service Provider is only the facilitator of transactions with credit cards, debit cards, or electronic cards linked to the Merchant and/or the Service Provider’s accounts by the orders of the Service User only. The Service Provider shall not be considered acting as a bank, financial institution, credit card or debit card or electronic card provider. The Service Provider shall not be considered as a trustee of the Service User. Should there be any issues, besides money transactions, arising from use of credit cards, debit cards, or electronic cards linked to the Merchant and/or the Service Provider’s accounts, the Service User agrees to contact the banks, financial institutions, credit card or debit card or electronic card providers directly by himself, without an involvement of the Service Provider in any way.
2.7 The Service User acknowledges that the conditions for payment of goods and/or services are in accordance with the terms and conditions of each Merchant. The Service Provider shall not be involved or responsible for all damages arising from suspension and/or cancellation of such service.
In addition, the Service Provider reserves the right to deny any payment services for goods and/or services as follows:
2.7.1 Payments for goods and/or services which are contrary to the law, good morals, regulations of the electronic card providers, or any other regulations that the Service Provider has specifically specified;
2.7.2 Payments for goods and/or services to the Merchant who does not comply with terms and conditions specified by the Service Provider;
2.7.3 Payments for goods and/or services which are contrary to the Anti-Money Laundering Law B.E. 2542, including any relevant announcements, rules and regulations that are currently effective and/or shall be effective in the future;
2.7.4 Payments for goods and/or services which are considered financial support for terrorism and proliferation of weapons of mass destruction;
2.7.5 Payments for goods and/or services which have reasonable grounds that the Service User has forged, distorted, or altered such transactions, or provided false information, or attempted to commit a crime, or any other actions that may cause damages to the Service Provider, Merchants, or any other persons;
2.8 In the event that there is an error in debiting money from the Service User’s account, and such error arises from the Service Provider, the Service User agrees to allow the Service Provider to correct any errors, as the fact may be. The Service Provider shall notify the Service User in advance of the cause and the amount of such error. Should such error cause the Service Provider to advance the money on behalf of the Service User, the Service User agrees to reimburse such money to the Service Provider in full afterwards.
2.9 The Service Provider does not have a refund policy. In the event of cancellation, alteration, and modification of the amount by the Service User after the transaction is complete, except the payments for goods and/or services that have been made via credit cards, the Service User must request refunds of such payments made via credit cards with the Merchant by himself, without an involvement of the Service Provider in any way.
The Service User acknowledges that the Service Provider is only the facilitator of transactions with credit cards, debit cards, or electronic cards linked to the Merchant and/or the Service Provider’s accounts by the orders of the Service User only. Consideration of refund of such payments for goods and/or services via credit cards of the Service User shall be upon the consideration of Merchants, banks, or financial institutions, or credit card providers. The Service User agrees not to raise such cause to claim for any damages from the Service Provider.
2.10 The Service Provider does not have a refund policy for the service fee as stated in Clause 2.2 in every and all cases, including monthly installment fees in the event the Service User has made installment payments for goods and/or services via credit cards.
3. Service User’s Testimonial
3.1 In the event that the Service User has Thai nationality, the Service User must certify that the Service User is 18 (eighteen) years of age or over, and is legally competent, or has obtained legal consent to use the Services, including agreeing to be bound by this Agreement, and/or entering into any agreements related to the use of service. Should the Service User be under 18 (eighteen) years of age, or has not reached his legal competency, such Service User must obtain a permission to use this service from his parent(s) or legal guardian(s). The parent(s) or legal guardian(s) of the Service User must accept these terms of service on behalf of the minor and shall be responsible for all use of service, including the use of service performed by the minor, which may execute right away or later, whether the minor is or will be supervised by the parent(s) or legal guardian(s) during the use of service or not.
In the event that the Service User is foreigner, the Service User must certify that the Service User is 18 (eighteen) years of age or over and is legally competent to be bound by this Agreement, and/or entering into any agreements related to the use of service, in accordance with the law of his country.
The Service User and/or legal guardian(s) of the Service User understands that the Service User must be responsible for financial, or any other consequences arising or may arise from the use of service conducted by the Service User or any third parties that the Service User and/or legal guardian(s) allows such person to use the Service User’s information for such actions.
3.2 The Service User certifies that the Service User will not use the service for any unlawful purposes, whether gambling, prostitution, money laundering, or any other purposes that is not for the payment of the Merchant’s goods and/or services, whether for the benefit of the Service User and/or any other persons, and such purposes have the nature of payment agent, or for the purpose of businesses which include any acts of violation of public order and good morals, infringement of intellectual property, or any other illegal acts. The Service User must not cause any damages to the electronic payment system “ChillPay” or any other network connected to electronic payment system “ChillPay”, or must not cause any interference with other person’s use of electronic payment system “ChillPay”, or must not attempt to enter the electronic payment system “ChillPay” by hacking, stealing, copying, destroying database, password mining, or any other means to cause damages to Service Provider, Merchants, or any other person.
Should there be any damages to the Service Provider, or the Service Provider be called upon to bear any liabilities arising from acts of the Service User for the above purposes, the Service Provider has the right to suspend or terminate the service immediately. The Service User shall be responsible for compensation to the Service Provider in all aspects. The Service Provider shall not be responsible for all damages that will occur.
3.3 The Service User certifies that information provided to the Service Provider is in accordance with these terms of service of this Agreement, and any other information that the Service User has provided to the Service Provider is correct in all aspects. Should there be a discovery that the Service User has forged any documents and/or impersonated another person regardless of other person’s consent on using the service, the Service Provider reserves the right to suspend or terminate the service immediately. The Service User shall be responsible for compensation to the Service Provider in all aspects, regardless of intentions to any fraud.
3.4 The Service User agrees to comply and cooperate, including agreeing to provide information and/or proof or documents that the Service Provider may request to provide for the purpose of consideration of the use of service, or for the purpose of compliance with the Rules and Regulations of the Bank of Thailand, the Anti-Money Laundering Office, or any provision of the law related to the operation under these terms of service, either the existing rules and regulations and/or the rules and regulations that will become effective in the future.
4. Limitation of Liabilities of the Service Provider
4.1 The Service User acknowledges that the receipt of payments for goods and/or services under this Agreement, should there be any errors, delays, or temporarily unavailable, whether due to the electronic network, cellular networks, computer network, system network, electronic appliances, and/or any force majeure, or beyond the control of the Service Provider, the Service User agrees not to raise the aforementioned obstructions as a claim for any damages from the Service Provider. The Service User must notify the Service Provider at once after such incident occurs. The Service Provider shall immediately try to resolve the issues that occurred. The Service User agrees to, at his best, cooperate with the Service Provider to resolve such problems.
4.2 The Service Provider shall not be liable for any loss or damage, directly or indirectly, which happened to the data on computers, mobile phones, or any other appliances arising from the service.
4.3 The Service Provider shall not be liable for any loss or damage, directly or indirectly, which happened to the data on computers, mobile phones, or any other appliances arising from the service.
4.4 The Service User acknowledges that the Service Provider is only the facilitator for payment services for goods and/or services, and any transactions according to the orders of the Merchants. The Service Provider has not involved in, participated in, supported in any actions related to the agreements between the Service User and the Merchant.
Should the Merchant have taken any actions, intentionally or not, which are illegal and/or caused damage to the Service User or any third parties, directly or indirectly, the Service User agrees not to raise such cause to claim for any damages from the Service Provider. Should the Service User have any disputes with the Merchant, the Service User agrees to contact the Merchant or supplier of such goods and/or services to resolve such disputes by himself.
4.5 The Service Provider reserves the right to assume any responsibilities related to Personal Data Protection Act or any other laws due to the concealment or inaccurate information provided by the Service User to the Service Provider. Should the Service User conceal or provide inaccurate information to the Service Provider, the Service User agrees to be responsible for any damages happening to the Service Provider and/or all third parties.
5. Personal Data
The Service User agrees and acknowledges that the Service Provider may collect, use, or disclose personal data, including but not limited to information on national ID card, contact information, location, biometrics, phone numbers, and email address of the Service User, and/or information that the Service User provided to the Service Provider, and/or in the possession of the Service Provider, and/or the Service Provider has lawfully received or collected from any other sources or any other persons. Such information shall be used for the purpose of considering the provisions of providing services, authentication/verification, statistical analysis, research for development of service or benefits that may be beneficial to the Service User, or focusing on providing Service User with good service, service supports, inquiries, delivering of information, including any actions related to marketing purposes, such as offering benefits, goods and/or services, any promotional programs that the Service User may be interested or beneficial. The notifications will be made through the Service Provider’s channel and the channels provided by the Service User, such as SMS, email, phone number, etc. The Service User acknowledges that the Service Provider may transmit or transfer Service User’s personal information to any juristic persons that have control over or are under the control of the Service Provider, and the juristic persons that are under the same control as the Service Provider, including any other juristic persons or any other persons that are contractual partners of or has legal relationship with the Service Provider, including external persons or external juristic persons who are responsible for processing personal information, domestically or internationally. In the event that the Service Provider is required to transmit or transfer personal information of Service User to foreign persons or juristic persons which have insufficient personal data protection standards, the Service Provider certifies that the Service Provider will take measures that are appropriate and consistent with the standards required by law to protect personal information of Service User.
The Service User may check and study other details through the Service Provider’s Privacy Policy at www.chillpay.co or any other channels specified by the Service Provider. The Service Provider’s Privacy Policy is deemed to be an integral part of this Agreement.
6. Any Other Agreements
6.1 This Agreement is governed by the laws of Thailand. Translation of this Agreement, whether translated into any languages, is only to facilitate the convenience of Service User only. The translation of this Agreement does not have any intentions to change or modify this Agreement. In the event of a conflict between the Thai edition and any other languages, the Thai edition shall prevail over other editions.
6.2 In the event that the Service User does not enforce any terms and conditions of this Agreement, such actions shall not affect the rights of the Service Provider to later enforce any terms and conditions. Waiver of the right to violate any terms and conditions committed by the Service User shall not be implied as a waiver of the right to violate such terms and conditions in a later time, or a waiver of any other terms and conditions.
The Service User has read and understood the essence of this Agreement, which is subject to change, modify, and add in the future. The Service User agrees that, by entering into the service of this electronic payment system, it is deemed accepted and bound by all terms and conditions of this Agreement.
ข้อกำหนดและเงื่อนไขที่ระบุไว้ดังต่อไปนี้ เป็นข้อตกลงระหว่าง บริษัท พระอินทร์ ฟินเทค จำกัด (ซึ่งต่อไปนี้เรียกว่า “ผู้ให้บริการ”) และผู้ใช้บริการชำระเงินผ่านระบบอิเล็กทรอนิกส์ (ซึ่งต่อไปนี้เรียกว่า “ผู้ใช้บริการ”) โดยที่ผู้ให้บริการประสงค์จะให้บริการเป็นตัวแทนรับชำระเงินค่าสินค้าและ/หรือค่าบริการของร้านค้าผู้จำหน่ายสินค้าและ/หรือบริการแก่ผู้ใช้บริการ (ซึ่งต่อไปนี้เรียกว่า “ร้านค้า”) ผ่านระบบอิเล็กทรอนิกส์หรือ Payment Gateway ภายใต้ชื่อทางการค้า ภาษาไทย “ชิวเพย์” หรือภาษาอังกฤษ “ChillPay” ทั้งนี้ผู้ใช้บริการมีหน้าที่อ่านเงื่อนไขในข้อตกลงการใช้บริการชำระเงินผ่านระบบอิเล็กทรอนิกส์ (ซึ่งต่อไปนี้เรียกว่า "ข้อตกลง") โดยละเอียดก่อนทำการใช้บริการชำระเงินดังกล่าว หากมีข้อสงสัยเกี่ยวกับข้อตกลง ผู้ใช้บริการสามารถติดต่อสอบถามได้ที่หมายเลขโทรศัพท์ 02-107-7788 หรือช่องทางอื่นตามที่ผู้ให้บริการกำหนด
ในการเข้าถึง และใช้บริการชำระเงินผ่านระบบอิเล็กทรอนิกส์นี้ ไม่ว่าโดยวิธีใดๆ ก็ตาม ผู้ใช้บริการจะต้องยอมรับเงื่อนไขของข้อตกลงนี้ หากผู้ใช้บริการไม่ยอมรับเงื่อนไขตามข้อตกลง กรุณายกเลิกการเข้าถึงและไม่ใช้บริการชำระเงินผ่านระบบอิเล็กทรอนิกส์ของผู้ให้บริการ ทั้งนี้ผู้ใช้บริการจะไม่ได้รับสิทธิในการเข้าใช้บริการชำระเงินผ่านระบบอิเล็กทรอนิกส์
ผู้ใช้บริการได้ให้ข้อตกลงไว้แก่ผู้ให้บริการมีข้อความดังต่อไปนี้
1. ข้อกําหนดทั่วไป
1.1 ผู้ใช้บริการตกลงที่จะปฏิบัติและผูกพันตามเงื่อนไขการให้บริการ ซึ่งการใช้บริการของผู้ใช้บริการถือเป็นการยอมรับเงื่อนไขการให้บริการนี้ โดยเนื้อความในข้อตกลงฉบับนี้อาจจะมีการเปลี่ยนแปลง แก้ไข หรือเพิ่มเติมได้ทุกเวลา โดยผู้ให้บริการไม่จำต้องแจ้งให้ผู้ใช้บริการทราบล่วงหน้า และการที่ผู้ใช้บริการใช้บริการต่อไปภายหลังจากที่มีการเปลี่ยนแปลงแก้ไขหรือเพิ่มเติมดังกล่าว ย่อมถือเป็นการยอมรับการเปลี่ยนแปลงแก้ไขหรือเพิ่มเติมในแต่ละครั้ง
1.2 เว้นแต่จะได้มีการแจ้ง หรือกําหนดไว้เป็นอย่างอื่น คุณลักษณะหรือเนื้อความในข้อตกลงที่ได้เปลี่ยนแปลง แก้ไข เพิ่มเติม หรือปรับปรุงในบริการให้ถือว่าอยู่ภายใต้เงื่อนไขการให้บริการฉบับนี้ทั้งสิ้น
1.3 ผู้ให้บริการสงวนสิทธิ์ในการปรับปรุงหรือยกเลิกการบริการ หรือส่วนใดส่วนหนึ่งของบริการ ไม่ว่าจะเป็นการชั่วคราว หรือตลอดไปได้ตลอดเวลา โดยไม่จำต้องแจ้งให้ผู้ใช้บริการทราบล่วงหน้า และผู้ใช้บริการไม่สามารถเรียกร้องค่าเสียหายใดๆ (ที่เกิดขึ้น) จากผู้ให้บริการอันเนื่องมาจากการกระทำดังกล่าวในทุกกรณี นอกจากนี้ หากเกิดความรับผิดชอบไม่ว่าทางแพ่งหรือทางอาญา รวมถึงความเสียหายใดๆขึ้นเนื่องจากการละเมิดหรือฝ่าฝืนเงื่อนไขในข้อตกลงนี้ ผู้ใช้บริการตกลงเป็นผู้รับผิดชอบแต่เพียงผู้เดียว โดยไม่เกี่ยวข้องกับผู้ให้บริการแต่ประการใด
2. การใช้บริการ
2.1 ผู้ให้บริการประสงค์จะให้บริการเป็นตัวแทนรับชำระเงินค่าสินค้าและ/หรือค่าบริการของร้านค้าผู้จำหน่ายสินค้าและ/หรือบริการแก่ผู้ใช้บริการผ่านระบบอิเล็กทรอนิกส์หรือ Payment Gateway ภายใต้ชื่อทางการค้า ภาษาไทย “ชิวเพย์” หรือภาษาอังกฤษ “ChillPay” และผู้ใช้บริการประสงค์ที่จะใช้บริการชำระเงินค่าสินค้าและ/หรือค่าบริการผ่านระบบอิเล็กทรอนิกส์ดังกล่าว (ซึ่งต่อไปนี้เรียกว่า "บริการ")
2.2 ผู้ใช้บริการตกลงยินยอมชําระค่าธรรมเนียมการใช้บริการตามอัตราที่ผู้ให้บริการกําหนด (หากมี) โดยผู้ใช้บริการสามารถตรวจสอบค่าธรรมเนียมได้ที่หน้าชำระเงินค่าสินค้าและ/หรือค่าบริการของร้านค้า ทั้งนี้ผู้ให้บริการสงวนสิทธิ์ในการเปลี่ยนแปลงอัตราค่าธรรมเนียมไม่ว่าเวลาใดได้ตลอดเวลา โดยไม่จำต้องแจ้งให้ผู้ใช้บริการทราบล่วงหน้า
2.3 ผู้ใช้บริการรับทราบว่าผู้ให้บริการเป็นเพียงผู้บริการอํานวยความสะดวกในการชําระ และ/หรือรับชำระค่าสินค้าและ/หรือค่าบริการ และทําธุรกรรมตามคําสั่งของร้านค้า ดังนั้นหากมีปัญหาเกิดขึ้นกับสินค้าและ/หรือบริการ หรือมีความชํารุดบกพร่องของสินค้า และ/หรือบริการ หรือเกิดข้อพิพาทใดๆ ผู้ใช้บริการต้องดําเนินการติดต่อกับร้านค้าผู้จำหน่ายสินค้าและ/หรือบริการเหล่านั้นด้วยตนเอง
อนึ่ง ในการให้บริการรับชําระค่าสินค้าและ/หรือค่าบริการ ผู้ให้บริการไม่มีส่วนรู้เห็นในสัญญา ข้อกําหนด หรือสิทธิและหน้าที่ต่าง ๆ ซึ่งผู้ใช้บริการและร้านค้ามีต่อกัน ดังนั้น หากมีข้อพิพาทอันเนื่องมาจากการให้บริการรับชําระค่าสินค้าและ/หรือบริการของผู้ให้บริการเกิดขึ้น ไม่ว่าจะเป็นการชําระหนี้เกินกําหนด การชําระหนี้เพียงบางส่วน การถูกระงับการให้บริการ หรือกรณีอื่นใด ผู้ใช้บริการจะต้องเป็นผู้รับผิดชอบ และ/หรือดําเนินการแก้ไขข้อพิพาทด้วยตนเอง โดยผู้ให้บริการไม่มีส่วนเกี่ยวข้องแต่อย่างใด
2.4 ผู้ใช้บริการยอมรับและยืนยันว่าการใช้บริการตามข้อตกลงฉบับนี้ ไม่มีลักษณะของการทำหน้าที่เป็นตัวแทนในการออกใบกำกับภาษีตามประกาศอธิบดีกรมสรรพากรเกี่ยวกับภาษีมูลค่าเพิ่ม (ฉบับที่ 68) เนื่องจากผู้ให้บริการเป็นเพียงผู้ให้บริการในการอํานวยความสะดวกในการชําระ และ/หรือรับชำระค่าสินค้าและ/หรือค่าบริการ และทําธุรกรรมตามคําสั่งของร้านค้าเท่านั้น หากผู้ใช้บริการประสงค์ได้รับใบกำกับภาษีค่าสินค้าและ/หรือค่าบริการที่ได้ชำระให้ทางร้านค้า ผู้ใช้บริการต้องดําเนินการติดต่อกับร้านค้าผู้จำหน่ายสินค้าและ/หรือบริการเหล่านั้นด้วยตนเอง
2.5 หากผู้ใช้บริการประสงค์ให้ผู้ให้บริการออกใบกำกับภาษีในส่วนค่าธรรมเนียมการใช้บริการในข้อ 2.2 (หากมี) ผู้ใช้บริการสามารถขอใบกำกับภาษีค่าธรรมเนียมดังกล่าวได้ที่หมายเลขโทรศัพท์ 02-107-7788 หรือช่องทางอื่นตามที่ผู้ให้บริการกำหนด ภายในวันที่ใช้บริการชำระเงินค่าสินค้าและ/หรือค่าบริการของร้านค้า
ผู้ให้บริการขอสงวนสิทธิ์ในการออกใบกำกับภาษีให้ผู้ใช้บริการที่ติดต่อหลังจากวันที่ใช้บริการชำระเงินค่าสินค้าและ/หรือค่าบริการดังกล่าว
2.6 ผู้ใช้บริการรับทราบว่าผู้ให้บริการเป็นเพียงผู้บริการอํานวยความสะดวกในการทําธุรกรรมด้วยบัตรเครดิต บัตรเดบิต หรือบัตรอิเล็กทรอนิกส์ที่ผูกกับบัญชีของร้านค้าและ/หรือผู้ให้บริการ ตามคําสั่งของผู้ใช้บริการเท่านั้น ทั้งนี้ไม่ถือว่าผู้ให้บริการกระทำการดังกล่าวในฐานะธนาคาร หรือสถาบันการเงิน หรือผู้ให้บริการบัตรเครดิต บัตรเดบิต บัตรอิเล็กทรอนิกส์ และไม่ถือว่าผู้ให้บริการกระทำการเป็นทรัสตี (trustee) ผู้ดูแลรักษาแทน หรือผู้บริหารผลประโยชน์ในเงินของผู้ใช้บริการ หากมีปัญหาเกิดขึ้นอันเนื่องมาจากการใช้บัตรเครดิต บัตรเดบิต หรือบัตรอิเล็กทรอนิกส์ที่ผูกกับบัญชีของร้านค้าและ/หรือผู้ให้บริการ นอกเหนือจากการทำธุรกรรมด้วยเงิน ผู้ใช้บริการตกลงติดต่อธนาคาร หรือสถาบันการเงิน หรือผู้ให้บริการบัตรเครดิต บัตรเดบิต บัตรอิเล็กทรอนิกส์ และ/หรือดําเนินการแก้ไขด้วยตนเอง โดยผู้ให้บริการไม่มีส่วนเกี่ยวข้องแต่อย่างใด
2.7 ผู้ใช้บริการรับทราบว่าเงื่อนไขในการชําระค่าสินค้าและ/หรือค่าบริการเป็นไปตามข้อกําหนดของร้านค้าแต่ละราย ผู้ให้บริการไม่มีส่วนเกี่ยวข้องหรือรับผิดชอบในความเสียหายที่จะเกิดขึ้นทั้งหมดอันเนื่องมาจากการระงับและ/หรือยกเลิกการใช้บริการดังกล่าว
อนึ่งผู้ให้บริการสงวนสิทธิ์ในการปฏิเสธการให้บริการชําระค่าสินค้าและ/หรือค่าบริการ ดังต่อไปนี้
2.7.1 การชำระค่าสินค้าและ/หรือค่าบริการ ซึ่งขัดต่อกฎหมาย ศีลธรรมอันดี ข้อกำหนดของผู้ให้บริการเครือข่ายบัตรอิเล็กทรอนิกส์ หรือข้อกำหนดอื่นใดที่ผู้ให้บริการอาจกำหนดไว้เป็นการเฉพาะ
2.7.2 การชำระค่าสินค้าและ/หรือค่าบริการ ให้ร้านค้าที่มิได้ปฏิบัติตามข้อกำหนดและเงื่อนไขที่ทางผู้ให้บริการกำหนดไว้
2.7.3 การชำระค่าสินค้าและ/หรือค่าบริการ ซึ่งขัดต่อพระราชบัญญัติการป้องกันและปรามปรามการฟอกเงิน พ.ศ. 2542 รวมถึงประกาศ และหลักเกณฑ์ที่เกี่ยวข้องซึ่งมีผลใช้บังคับอยู่ในปัจจุบัน และ/หรือที่จะมีผลใช้บังคับในภายหน้า
2.7.4 การชำระค่าสินค้าและ/หรือค่าบริการ ซึ่งเข้าข่ายการสนับสนุนทางการเงินแก่การก่อการร้ายและการแพร่ขยายอาวุธที่มีอานุภาพทำลายล้างสูง
2.7.5 การชำระค่าสินค้าและ/หรือค่าบริการ อันมีเหตุอันควรเชื่อได้ว่าผู้ใช้บริการได้ปลอมแปลงหรือบิดเบือนหรือแก้ไขข้อมูลการทำธุรกรรมดังกล่าว หรือให้ข้อมูลอันเป็นเท็จ หรือพยายามกระทำความผิดตามที่กฎหมายกำหนด หรือเหตุใดๆ ก็ตาม ที่อาจก่อให้เกิดความเสียหายกับผู้ให้บริการ ร้านค้า หรือบุคคลอื่นใด
2.8 ในกรณีที่เกิดความผิดพลาดในการหักเงินจากบัญชีของผู้ใช้บริการอันเกิดขึ้นจากผู้ให้บริการ ผู้ใช้บริการยินยอมให้ผู้ให้บริการแก้ไขความผิดพลาดที่เกิดขึ้นให้ถูกต้องได้ตามความเป็นจริง โดยผู้ให้บริการจะแจ้งให้ผู้ใช้บริการทราบล่วงหน้าถึงเหตุและจำนวนเงินที่ผิดพลาดดังกล่าว และหากความผิดพลาดดังกล่าวเป็นเหตุให้ผู้ให้บริการต้องชำระเงินแทนผู้ใช้บริการไปก่อน ผู้ใช้บริการตกลงชำระคืนให้แก่ผู้ให้บริการจนครบถ้วนในภายหลัง
2.9 ผู้ให้บริการไม่มีนโยบายในการคืนเงิน (Refund) กรณีที่มีการยกเลิก แก้ไข เปลี่ยนแปลง ยอดเงินที่ได้ทำธุรกรรมเสร็จสิ้นแล้วจากผู้ใช้บริการ ยกเว้นการชำระค่าสินค้าและ/หรือค่าบริการผ่านบัตรเครดิต (Credit Card) ซึ่งผู้ใช้บริการต้องดำเนินการร้องขอคืนเงินที่ชำระผ่านบัตรเครดิตดังกล่าวกับทางร้านค้าด้วยตัวเอง โดยผู้ให้บริการไม่มีส่วนเกี่ยวข้องแต่อย่างใด
ทั้งนี้ผู้ใช้บริการรับทราบว่าผู้ให้บริการเป็นเพียงผู้บริการอํานวยความสะดวกในการทําธุรกรรมด้วยบัตรเครดิต หรือบัตรอิเล็กทรอนิกส์ที่ผูกกับบัญชีของร้านค้าและ/หรือผู้ให้บริการ ตามคําสั่งของผู้ใช้บริการเท่านั้น การพิจารณาดำเนินการคืนเงินค่าสินค้าและ/หรือค่าบริการผ่านบัตรเครดิตของผู้ใช้บริการ ขึ้นอยู่กับการพิจารณาของร้านค้า ธนาคาร หรือสถาบันการเงิน หรือผู้ให้บริการบัตรเครดิต ผู้ใช้บริการตกลงจะไม่ยกเอาเหตุดังกล่าวมาเป็นข้อเรียกร้องค่าเสียหายใด ๆ จากผู้ให้บริการเป็นอันขาด
2.10 ผู้ให้บริการไม่มีนโยบายในการคืนเงินค่าธรรมเนียมการใช้บริการในข้อ 2.2 ในทุกกรณี ทั้งนี้ให้รวมถึงค่าธรรมเนียมการผ่อนชำระรายเดือน ในกรณีที่ผู้ใช้บริการได้ทำการผ่อนสินค้าและ/หรือบริการผ่านบัตรเครดิต (Installment)
3. คํารับรองของผู้ใช้บริการ
3.1 กรณีที่ผู้ใช้บริการมีสัญชาติไทย ผู้ใช้บริการรับรองว่าผู้ใช้บริการมีอายุครบ 18 (สิบแปด) ปีบริบูรณ์ขึ้นไปและเป็นผู้มีความสามารถตามกฎหมาย หรือได้รับความยินยอมตามกฎหมายในการใช้บริการ รวมทั้งยินยอมผูกพันตามเงื่อนไขการให้บริการฉบับนี้ และ/หรือการเข้าทำสัญญาใดๆ ที่เกี่ยวข้องกับการใช้บริการ หากผู้ใช้บริการมีอายุน้อยกว่า 18 (สิบแปด) ปี หรือยังไม่บรรลุนิติภาวะตามกฎหมาย ผู้ใช้บริการคนดังกล่าวจะต้องได้รับอนุญาตจากผู้ปกครองหรือผู้พิทักษ์ตามกฎหมายเพื่อใช้บริการ และผู้ปกครองหรือผู้พิทักษ์ตามกฎหมายจะต้องยอมรับข้อตกลงการใช้บริการนี้ในนามของผู้เยาว์และจะเป็นผู้รับผิดชอบการใช้บริการทั้งหมด รวมไปถึงการใช้บริการที่กระทำโดยผู้เยาว์ ซึ่งจะถูกดำเนินการตอนนี้หรือจะถูกดำเนินการในภายหลัง และไม่ว่าผู้เยาว์จะได้รับการดูแลจากผู้ปกครอง หรือผู้พิทักษ์ตามกฎหมายในระหว่างการใช้บริการหรือไม่ก็ตาม
กรณีที่ผู้ใช้บริการเป็นชาวต่างชาติ ผู้ใช้บริการรับรองว่าผู้ใช้บริการมีอายุครบ 18 (สิบแปด) ปีบริบูรณ์แล้ว และเป็นผู้มีความสามารถในการผูกพันตามเงื่อนไขการให้บริการฉบับนี้ และ/หรือการเข้าทำสัญญาใดๆ ที่เกี่ยวข้องกับการใช้บริการ โดยเป็นไปตามที่กฎหมายในประเทศของตนเองกำหนด
ทั้งนี้ ผู้ใช้บริการ และ/หรือผู้ดูแลตามกฎหมายของผู้ใช้บริการเข้าใจดีว่าผู้ใช้บริการต้องรับผิดชอบต่อผลทางการเงิน หรือผลอื่นใดที่เกิดขึ้น หรืออาจเกิดขึ้นอันเนื่องมาจากการใช้บริการที่ผู้ใช้บริการเป็นผู้กระทํา หรือที่ผู้ใช้บริการ และ/หรือผู้ดูแลตามกฎหมายของผู้ใช้บริการอนุญาตให้บุคคลที่สามใช้ข้อมูลอื่นใดของผู้ใช้บริการกระทำการแทน
3.2 ผู้ใช้บริการรับรองว่าจะไม่ใช้บริการในการกระทำใดๆที่มีวัตถุประสงค์อันมิชอบด้วยกฎหมาย ไม่ว่าจะเป็นการพนัน การค้าบริการทางเพศ การฟอกเงิน หรือนำบริการไปแสวงหาประโยชน์อื่นใดที่ไม่ได้เป็นไปเพื่อการชำระเงินค่าสินค้าและ/หรือค่าบริการของร้านค้า ไม่ว่าจะเพื่อประโยชน์ของผู้ใช้บริการและ/หรือบุคคลอื่น ซึ่งมีลักษณะเป็นตัวแทนรับชำระเงิน หรือนำไปประกอบธุรกิจในรูปแบบต่าง ๆ รวมถึง การกระทําซึ่งมีลักษณะฝ่าฝืนต่อความสงบเรียบร้อยศีลธรรมอันดีของประชาชน ละเมิดสิทธิทางทรัพย์สินทางปัญญาของผู้อื่น หรือเป็นการกระทําผิดกฎหมายอื่นใด รวมถึงจะไม่ทำให้ระบบชำระเงินผ่านระบบอิเล็กทรอนิกส์ ชิวเพย์ ChillPay หรือเครือข่ายที่เชื่อมต่อกับระบบชำระเงินผ่านระบบอิเล็กทรอนิกส์ ชิวเพย์ ChillPay ต้องเสียหาย หรือจะไม่ทำให้เกิดการรบกวนการใช้งานระบบชำระเงินผ่านระบบอิเล็กทรอนิกส์ ชิวเพย์ ChillPay ของบุคคลอื่นใด หรือจะไม่พยายามเข้าสู่ระบบชำระเงินผ่านระบบอิเล็กทรอนิกส์ ชิวเพย์ ChillPay ด้วยวิธีการเจาะระบบ (hacking) ขโมย สำเนา หรือทำลายฐานข้อมูล ทำลายรหัสลับส่วนตัว (password mining) หรือวิธีการอื่นใด ที่จะสร้างความเสียหายให้ผู้ให้บริการ ร้านค้า หรือบุคคลใดๆ
หากเกิดความเสียหายใดๆ ขึ้นแก่ผู้ให้บริการ หรือผู้ให้บริการถูกเรียกร้องให้ต้องรับผิดใดๆ จากการที่ผู้ใช้บริการกระทำการใดๆผ่านบริการของผู้ให้บริการเพื่อจุดประสงค์ดังกล่าวข้างต้น ผู้ให้บริการมีสิทธิระงับหรือยกเลิกการให้บริการได้ทันที และผู้ใช้บริการจะต้องรับผิดชอบชดใช้ค่าเสียหายให้แก่ผู้ให้บริการทุกประการ ทั้งนี้ผู้ให้บริการไม่มีส่วนเกี่ยวข้องหรือรับผิดชอบในความเสียหายทั้งหมดที่จะเกิดขึ้น
3.3 ผู้ใช้บริการรับรองว่าข้อมูลที่ให้แก่ผู้ให้บริการตามเงื่อนไขการให้บริการฉบับนี้ และข้อมูลอื่นใดที่ผู้ใช้บริการส่งมอบให้แก่ผู้ให้บริการ เป็นข้อมูลที่ถูกต้องทุกประการ หากผู้ให้บริการตรวจพบว่าผู้ใช้บริการปลอมแปลงข้อมูลเอกสาร และ/หรือสวมรอยเป็นบุคคลใดไม่ว่าบุคคลนั้นจะยินยอมหรือไม่ในการใช้บริการนี้ ผู้ให้บริการสงวนสิทธิ์ระงับหรือยกเลิกการให้บริการได้ทันที และผู้ใช้บริการจะต้องรับผิดชอบชดใช้ค่าเสียหายให้แก่ผู้ให้บริการทุกประการ ทั้งนี้ ไม่ว่าผู้ใช้บริการจะมีเจตนาทุจริตหรือไม่ก็ตาม
3.4 ผู้ใช้บริการตกลงผูกพันปฏิบัติตามและให้ความร่วมมือ รวมถึงตกลงจัดเตรียมข้อมูลและ/หรือจัดส่งเอกสารหลักฐาน หรือเอกสารใดๆ ซึ่งผู้ให้บริการอาจร้องขอให้ส่งเพิ่มเติมเพื่อวัตถุประสงค์ในการพิจารณาให้ใช้บริการ หรือเพื่อปฏิบัติตามข้อกําหนด ประกาศกฎระเบียบของธนาคารแห่งประเทศไทย สํานักงานป้องกันและปราบปรามการฟอกเงิน หรือบทบัญญัติของกฎหมายใดๆ ที่เกี่ยวข้องกับการดําเนินการตามเงื่อนไขการให้บริการฉบับนี้ ทั้งที่มีอยู่ในปัจจุบันและ/หรือที่จะมีขึ้นต่อไปในภายหน้าโดยเคร่งครัด
4. ข้อจำกัดการรับผิดของผู้ให้บริการ
4.1 ผู้ใช้บริการรับทราบว่าการรับชำระค่าสินค้าและ/หรือค่าบริการภายใต้ข้อตกลงนี้ หากเกิดความผิดพลาดล่าช้าหรือไม่อาจให้บริการได้เป็นการชั่วคราวไม่ว่าเกิดจากระบบเครือข่ายการให้บริการทางอิเล็กทรอนิกส์ หรือระบบเครือข่ายโทรศัพท์เคลื่อนที่ หรือระบบคอมพิวเตอร์ หรือระบบเน็ตเวิร์ค หรืออุปกรณ์อิเล็กทรอนิกส์ต่าง ๆ และ/หรือไม่ว่าจะเกิดจากเหตุเหตุสุดวิสัย หรืออยู่นอกเหนือการควบคุมของผู้ให้บริการ ผู้ใช้บริการตกลงจะไม่ยกเอาเหตุขัดข้องดังกล่าวมาเป็นข้อเรียกร้องค่าเสียหายใด ๆ จากผู้ให้บริการเป็นอันขาด และผู้ใช้บริการจะต้องแจ้งให้ผู้ให้บริการทราบทันทีที่เกิดเหตุดังกล่าวขึ้น โดยผู้ให้บริการจะพยายามแก้ไขปัญหาที่เกิดขึ้นโดยเร่งด่วน ทั้งนี้ ผู้ใช้บริการตกลงจะให้ความร่วมมือกับผู้ให้บริการในการแก้ไขปัญหาที่เกิดขึ้นอย่างดีที่สุด
4.2 ผู้ให้บริการจะไม่รับผิดชอบในทุกกรณีต่อความสูญหาย หรือเสียหาย ไม่ว่าจะโดยทางตรง หรือโดยทางอ้อม อันเกิดขึ้นกับข้อมูลในเครื่องคอมพิวเตอร์ หรือโทรศัพท์เคลื่อนที่ หรืออุปกรณ์อื่นใดอันเป็นผลมาจากการให้บริการ
4.3 ผู้ให้บริการไม่รับผิดชอบในความเสียหาย หรือความสูญหายที่เกิดกับเงินของผู้ใช้บริการและ/หรือเงินในบัตรเครดิต บัตรเดบิต หรือบัตรอิเล็กทรอนิกส์ของผู้ใช้บริการ อันเนื่องจาก Malware หรือ Computer Virus หรือจากการโจมตีทางอิเล็กทรอนิกส์อื่นใด บนเครื่องคอมพิวเตอร์ โทรศัพท์เคลื่อนที่ หรืออุปกรณ์อื่นใดของผู้ใช้บริการที่ใช้บริการ หรือจากการที่เครื่องคอมพิวเตอร์ โทรศัพท์เคลื่อนที่ หรืออุปกรณ์อื่นใดของผู้ใช้บริการได้สูญหาย หรือถูกขโมย หรือผู้ใช้บริการถูกหลอกลวง หรือจากเหตุสุดวิสัยอื่นใด โดยผู้ใช้บริการจะต้องแจ้งขอระงับการใช้เงินในบัญชีต่อธนาคาร หรือสถาบันการเงิน หรือผู้ให้บริการบัตรเครดิต บัตรเดบิต บัตรอิเล็กทรอนิกส์โดยทันที ในกรณีที่เกี่ยวกับเงินของผู้ใช้บริการ
4.4 ผู้ใช้บริการรับทราบว่าผู้ให้บริการเป็นเพียงผู้บริการอํานวยความสะดวกในการชําระ และ/หรือรับชำระค่าสินค้าและ/หรือค่าบริการ และทําธุรกรรมตามคําสั่งของร้านค้า ผู้ให้บริการไม่มีส่วนรู้เห็น หรือมีส่วนร่วม หรือให้การสนับสนุนในการกระทำการใดๆอันเกี่ยวกับข้อตกลงระหว่างผู้ใช้บริการกับร้านค้า
หากร้านค้าได้กระทำการใดๆ ไม่ว่าจะด้วยเจตนาหรือไม่ก็ตาม อันเป็นการกระทำผิดกฎหมาย และ/หรือก่อให้เกิดความเสียหายต่อผู้ใช้บริการ บุคคลอื่น ไม่ว่าทางตรงหรือทางอ้อม ผู้ใช้บริการตกลงจะไม่ยกเอาเหตุดังกล่าวมาเป็นข้อเรียกร้องค่าเสียหายใดๆ จากผู้ให้บริการเป็นอันขาด หากผู้ใช้บริการมีข้อพิพาทใดๆกับร้านค้า ผู้ใช้บริการตกลงจะดําเนินการติดต่อกับร้านค้าผู้จำหน่ายสินค้าและ/หรือบริการเหล่านั้นเพื่อแก้ไขข้อพิพาทดังกล่าวด้วยตนเอง
4.5 ผู้ให้บริการขอสงวนสิทธิ์ในการรับผิดชอบใดๆ ก็ตามอันเกี่ยวกับกฎหมายคุ้มครองข้อมูลส่วนบุคคล หรือกฎหมายอื่นใดก็ตาม อันเนื่องมาจาการที่ผู้ใช้บริการปกปิดข้อมูล หรือให้ข้อมูลที่ไม่ตรงกับความเป็นจริงแก่ผู้ให้บริการ หากผู้ใช้บริการปกปิดข้อมูล หรือให้ข้อมูลที่ไม่ตรงกับกับความเป็นจริงดังกล่าว ผู้ใช้บริการตกลงรับผิดชอบในความเสียหายใดๆ ที่เกิดขึ้นกับผู้ให้บริการ และ/หรือบุคคลภายนอกทั้งสิ้น
5. ข้อมูลส่วนบุคคล
ผู้ใช้บริการตกลงและรับทราบว่า ผู้ให้บริการอาจดำเนินการเก็บรวบรวม ใช้ หรือเปิดเผย ข้อมูลส่วนบุคคล ซึ่งรวมถึงแต่ไม่จำกัดเพียง ข้อมูลตามบัตรประชาชน ข้อมูลที่จำเป็นในการติดต่อ ตำแหน่งที่อยู่ (location) ข้อมูลชีวภาพ (Biometrics) ข้อมูลหมายเลขโทรศัพท์ และอีเมล์อิเล็กทรอนิกส์ของผู้ใช้บริการ และ/หรือที่ผู้ใช้บริการที่ได้ให้ไว้แก่ผู้ให้บริการ และ/หรือที่อยู่ในความครอบครองของผู้ให้บริการและ/หรือที่ผู้ให้บริการได้รับหรือเก็บรวบรวมจากแหล่งอื่นหรือบุคคลอื่นใดโดยถูกต้องตามกฎหมาย เพื่อวัตถุประสงค์ในการพิจารณาการให้บริการ การพิสูจน์/ยืนยันตัวตน การทำสถิติ การวิเคราะห์วิจัยข้อมูลเพื่อพัฒนาบริการหรือให้สิทธิประโยชน์ที่อาจเป็นประโยชน์ต่อผู้ใช้บริการอันเกี่ยวเนื่องกับบริการ หรือมุ่งเน้นให้ผู้ใช้บริการได้รับบริการที่ดี การให้บริการช่วยเหลือ การติดต่อสอบถาม การส่งข้อมูลข่าวสาร รวมถึงการดำเนินการใดๆ เพื่อวัตถุประสงค์ทางการตลาดที่เกี่ยวข้องกับบริการ เช่น การเสนอสิทธิประโยชน์, สินค้าและ/หรือบริการ, รายการส่งเสริมการขายใด ๆ ที่ผู้ใช้บริการอาจสนใจหรือเป็นประโยชน์แก่ผู้ใช้บริการ ผ่านช่องทางการแจ้งเตือนของผู้ให้บริการและช่องทางการติดต่อที่ผู้ใช้บริการได้แจ้งไว้ เช่น SMS, อีเมล์อิเล็กทรอนิกส์, หมายเลขโทรศัพท์เคลื่อนที่ เป็นต้น และผู้ใช้บริการรับทราบว่าผู้ให้บริการอาจส่งหรือโอนข้อมูลส่วนบุคคลของผู้ใช้บริการให้แก่นิติบุคคลที่มีอำนาจควบคุมผู้ให้บริการหรืออยู่ภายใต้การควบคุมของผู้ให้บริการ และนิติบุคคลที่อยู่ภายใต้การควบคุมเดียวกันกับผู้ให้บริการ รวมถึงนิติบุคคลหรือบุคคลอื่นใดที่ผู้ให้บริการเป็นคู่สัญญาหรือมีนิติสัมพันธ์ด้วย ตลอดจนบุคคลหรือนิติบุคคคลภายนอกซึ่งมีหน้าที่ประมวลผลข้อมูลส่วนบุคคลทั้งภายในและนอกประเทศ ทั้งนี้ กรณีที่ผู้ให้บริการมีความจำเป็นที่จะต้องส่งหรือโอนข้อมูลส่วนบุคคลของผู้ใช้บริการไปยังบุคคลหรือนิติบุคคลนอกประเทศที่มีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลไม่เพียงพอตามที่กฎหมายกำหนด ผู้ให้บริการรับรองว่าผู้ให้บริการจะดำเนินการให้มีมาตรการคุ้มครองข้อมูลส่วนบุคคลที่เหมาะสมและสอดคล้องกับมาตรฐานตามที่กฎหมายกำหนด
ผู้ใช้บริการสามารถตรวจสอบและศึกษารายละเอียดอื่น ๆ ผ่านนโยบายการคุ้มครองข้อมูลส่วนบุคคลของผู้ให้บริการ ได้ที่ www.chillpay.co หรือช่องทางอื่นตามที่ผู้ให้บริการกำหนด ทั้งนี้ถือว่านโยบายการคุ้มครองข้อมูลส่วนบุคคลของผู้ให้บริการถือเป็นส่วนหนึ่งของข้อตกลงฉบับนี้
6. ข้อตกลงอื่นๆ
6.1 ข้อตกลงนี้อยู่ภายใต้บังคับของกฎหมายไทย การแปลข้อตกลงฉบับนี้ ไม่ว่าจะแปลเป็นภาษาใดก็ตาม มีไว้เพื่ออำนวยความสะดวกของผู้ใช้บริการเท่านั้น ไม่ได้มีเจตนาใดๆที่จะปรับเปลี่ยนข้อตกลง ในกรณีที่มีข้อความขัดแย้งกันระหว่างฉบับภาษาไทยและภาษาอื่นๆที่ไม่ใช่ภาษาไทย ให้ยึดข้อความตามภาษาไทยเป็นหลัก
6.2 ในกรณีที่ผู้ให้บริการไม่บังคับใช้ข้อกำหนด หรือเงื่อนไขใดของเงื่อนไขการให้บริการนี้ จะไม่กระทบถึงสิทธิของผู้ให้บริการในการบังคับใช้ข้อกำหนด หรือเงื่อนไขนั้นในภายหลัง และการสละสิทธิในการกระทำผิดข้อกำหนด หรือเงื่อนไขใดของผู้ใช้บริการ จะไม่ถือเป็นการสละสิทธิในการกระทำผิดข้อกำหนด หรือเงื่อนไขดังกล่าวครั้งต่อไป หรือการสละสิทธิในข้อกำหนด หรือเงื่อนไขอื่นใด
ผู้ใช้บริการได้อ่าน และเข้าใจข้อความในข้อตกลงนี้และที่อาจมีการแก้ไขเปลี่ยนแปลง เพิ่มเติมในอนาคตโดยตลอดแล้ว และตกลงว่าการเข้าใช้บริการชำระเงินผ่านระบบอิเล็กทรอนิกส์เป็นการยอมรับ และผูกพันตามเงื่อนไขต่างๆของข้อตกลงนี้
